Bakersfield Motorcycle Accidents and Wrongful Death Claims

California law requires all riders to operate motorcycles and off-road vehicles with reasonable care and to take precautions appropriate to the terrain and conditions. When a fatal crash occurs, whether on a public road or an adjacent dirt field, the circumstances are subject to investigation to determine whether any third party may bear liability for the rider’s death.

Depending on the findings of the ongoing investigation, the family of the deceased may have the right to pursue a wrongful death claim. A wrongful death claim can provide compensation for funeral expenses, loss of financial support, loss of consortium, and other damages related to the fatal accident.

Comparative Negligence

California Law follows the legal concept of comparative negligence. Under comparative negligence, more than one party might share liability in a personal injury accident. Injured victims may have their compensation reduced if they are found partially liable in the accident that caused their injury.
