San Luis Obispo County, CA – Lucio Ornelas Avina, 34, of Paso Robles has been identified as the driver killed on the afternoon of Monday, February 3, 2025, when his vehicle crashed into a fence and caught fire, according to The San Luis Obispo Tribune.
The California Highway Patrol (CHP) reports that the accident took place around 4:20 PM near 10000 Creston Road, north of Highway 41.
Authorities stated that Avina was driving a 2005 Ford Escape northbound on Creston Road at what is believed to have been an unsafe speed when he lost control of the vehicle. The car veered off the roadway south of Camp 8 Road and crashed into an oil pipe fence. Witnesses reported that the vehicle quickly became engulfed in flames.
Emergency responders from CHP, the San Luis Obispo County Coroner’s Office, Cal Fire, and the Paso Robles Fire Department arrived at the scene. Officers found the vehicle resting on top of a six-foot-tall fence, with Avina still inside. He was pronounced dead at the scene.
The San Luis Obispo County Coroner’s Office later identified Avina and notified his next of kin. Officials have not determined whether alcohol or drugs played a role in the crash.
The incident remains under investigation.
Single-Vehicle Collisions and Comparative Negligence
In some cases, investigations may reveal that even in a single-vehicle accident, nearby drivers or unsafe road features share some responsibility.
California’s Comparative Negligence rule means that, even if those injured in accidents are found partially at fault, they may still be eligible to receive partial compensation for damages.
A San Luis Obispo Car Accident Lawyer can play a critical role in sorting through these details to help victims and their families get the compensation they deserve.
