Can I Ride a Scooter in Bike Lanes in CA?
California vehicle codes encourage motorized scooter users to ride in lanes set aside for cyclists. However, cities and municipalities are allowed to set their own rules on scooters, so it’s always important to check local statutes regarding bike lane use.
Scooters in California Bike Lanes and on Other Paths
California Vehicle Code (CVC) §21230 makes it legal for people riding e-scooters to utilize bike lanes. Motorized scooters are also allowed on bikeways and trails designated for bicyclists.
Local governments are permitted to come up with their own rules regarding scooter riding and some cities may prohibit scooters from using bike lanes. It’s a good idea to check local traffic laws before taking your scooter onto a bike path.
Scooters on California Streets
When bike lanes aren’t available, scooter riders are allowed to use traffic lanes, but generally only if the street’s speed limit is 25 mph or less. There may be cases where local statutes allow for scooters on certain roads with a 35 mph speed limit. Check locally to see what your city allows.
There are a few other codes to keep in mind when traveling by scooter:
- it’s illegal to travel on a highway if using an e-scooter with handlebars that require the user to place his/her hands above his/her shoulders.
- Scooters must not exceed 15 mph no matter if they are on the street or in a bike path.
- E-scooters must come equipped with a brake.
- Anyone transporting bags or bundles while on an e-scooter must keep one hand on a handlebar at all times.
Also, make sure you are actually riding a scooter. Check out the California DMV’s definition of a scooter. If your vehicle is more powerful or is closer to something like a motor-driven cycle, you might be under an entirely different set of laws and requirements.
