With that said, the specifics really drive this point home. In California, deepfake porn is considered a form of sexual abuse because of the following:

  • Non-consensual – It involves using someone’s likeness in explicit content without their permission is a violation of their consent.

Even though it’s relatively new technology, the problem of deepfake porn videos has become serious enough that California law has gone to great lengths to address it. The California legislature passed Assembly Bill (AB) 602 in 2019, which makes it illegal to:

  • Create and share sexually explicit material when the creator knows or should have known the depicted person didn’t consent to it, or;
  • Share explicit material made by someone else knowing the depicted person didn’t consent.

Effectively, this means that if you’re victimized as a depicted person in a deepfake porn video, you can file an injury claim for damages.

How Do You Recover Damages in a Deepfake Porn Video Claim?

At its core, a deepfake porn video is simply another version of sexual abuse that you could be victimized by. This gives you the legal right to file an injury claim against whoever is responsible. Most of the time, this is going to be the person who created and then shared the video, but it could also include websites that posted the video or circulated it to others.

Regardless of liability, you recover damages by actually filing your claim. Typically, you do this either out of court with an insurance claim, but you might have a better chance at full recovery by filing a personal injury lawsuit inside the court system. Your damages are going to be specific to your particular case, but usually includes things like:

  • Between January 1, 2009, and January 1, 2019 – With the passage of AB 2777, survivors have a three-year “lookback” window, allowing them to file a lawsuit until December 31, 2026.

  • Protect your online presence – Make your online accounts safer by changing your passwords and keeping an eye out for anything unusual.
