Knowing When You Could Earn More for Your Recovery with a Lawyer
When accidents only involve very minor wounds or soreness, or just vehicle damage, a lawyer may not be needed. However, when serious injuries, like broken bones, Traumatic Brain Injuries, back and neck injuries, are involved, a lawyer’s help becomes a valuable advantage.
A lawyer is often able to protect your case by fully investigating what happened and using the evidence to keep the blame on the delivery driver. A lawyer can also be a multiplier for your settlement check, often winning more than you could by taking on Shipt yourself.
You can always file a claim yourself, but insurance companies and Shipt lawyers can take advantage of you when you don’t know your full rights. They can downplay the accident and convince you to accept less than you should in compensation. They may even convince you that the driver is the only one responsible for your damages.

What Shipt Should Cover for You After an Accident
Shipt drivers try to proceed as safely as possible. But a Shipt driver can have work deadlines, adding to the stress of California traffic.
Their mistakes can affect anyone who uses freeways and boulevards. That includes drivers in cars, SUVS, and pick-ups, and riders on motorcycles. A distracted Shipt driver on a delivery and in a rush can hurt a pedestrian trying to cross the street or a cyclist in a bike lane.
Victims might come away with major injuries that affect their lives for months. Victims in a crash might also suffer life-threatening injuries, sometimes leading to permanent disabilities.
Shipt accident victims need to be able to count on full support for these and other hardships while they try to heal:
- Current medical expenses and those expected in the weeks to come.
- Estimated costs associated with a long-term injury or permanent physical disability.
- Emotional anguish suffered. The loss of enjoyment of life due to an injury. The loss of consortium (loss of intimacy with a spouse).
- Physical pain endured in an impact and during recovery.
- Past and future lost paychecks from work during recovery.
- Property damage to pay for car repairs if a delivery worker strikes someone’s vehicle.
- Wrongful death benefits. A family that has lost a loved one to a Shipt driver’s mistake must file a wrongful death claim. This claim asks an insurance company for help with funeral costs. It also seeks to replace the income the deceased would have provided the family in the future. The emotional toll a fatal accident takes must also earn support.
Shipt Accident Dangers in California
Shipt sends drivers out across hundreds of California cities each day. First, they make a trip to the store, and then they get behind the wheel to find the shopper’s address. It’s a lot of time on our local roads, and it’s all being driven by workers who have to worry about more than just what’s in the lanes ahead.
Delivery drivers are working while also dealing with traffic issues. It’s a combination that can lead to trouble.
These are a few of the reasons a Shipt driver may cause an accident:
Delivery deadlines: Order Up! Shipt drivers can be tempted to break the speed limit or race through yellow and red lights to keep customers happy. They can choose to speed or drive aggressively, leading to a higher risk of accidents.
Finding locations: Delivery drivers can become obstacles as they seek out unfamiliar store or home addresses, relying on phone navigation, but also taking their eyes off the lanes at times.
Cellphone distractions: Shipt workers use an app to be alerted to orders and to stay in contact with customers. Glancing down at a phone message can be a serious driver distraction.
Driver condition: Delivery drivers can put everyone at risk when they are on the road without enough sleep. Drowsy drivers can cause major accidents. A driver choosing to clock in after having used drugs or alcohol can also be a dangerous threat.
Shipt car maintenance: Drivers for Shipt use their own vehicles, and that’s a big responsibility when representing a business out on the freeway. They must keep tires with enough tread on them. They must keep brakes in working order. If a Shipt vehicle maintenance is neglected, it can lead to a collision and injuries.
Figuring Out Who Is Liable for a Shipt Accident
Shipt requires its drivers to have their own car insurance for accidents. Shipt does carry some car insurance for the victims of accidents. However, it only covers drivers at certain times of their shift, and it’s only meant to back up the driver’s personal insurance coverage.
Driver’s Insurance: Shipt wants to keep its GIG drivers classified as independent contract workers so it doesn’t have to accept responsibility for accidents. They require their “shoppers” and “package delivery drivers” to carry their own insurance. The problem is that a normal car insurance company will usually reject a claim if a policyholder is in an accident while driving for an employer. Ships recommends that drivers get commercial auto insurance coverage, but that’s expensive, and not many workers will take that step.
Shipt Accident Insurance: Shipt does provide excess liability insurance for drivers, but it’s only supposed to apply when accidents happen while drivers are on their way to a customer’s house with groceries. What’s more, Shipt will still make you file a claim with the driver’s insurance provider first. Shipt’s policy is meant to kick-in if a driver’s policy had low limits and doesn’t cover all of your medical bills. It may also provide coverage if a driver’s insurer rejects your claim.
A skilled Maison Law attorney can determine who to send a claim to (in some cases, multiple claims). A lawyer can also find ways to hold Shipt responsible, even when they try to deflect all blame. Shipt and its parent company Target should always be accountable for the drivers they hire and the dangers their business practices cause for the rest of us.
