Support for Autoimmune Disease Victims and Their Families Under the Camp Lejeune Justice Act

The Camp Lejeune Justice Act (CLJA) was enacted in August of 2022. From that date, victims exposed to Camp Lejeune’s hazardous water supplies have up to two years to file an injury claim against the U.S. Department of Defense. Those eligible for Camp Lejeune settlement money will include victims who developed an autoimmune disease and their families who suffered emotional and financial hardships.

To receive compensation, victims must document that they served, lived, or worked at Camp Lejeune for at least 30 days at any point between August 1, 1953, and December 31, 1987. The children of parents who spent time at Camp Lejeune who developed autoimmune diseases would need to prove that their parents were at Camp Lejeune over this period. The 30 days of exposure do not have to have been on consecutive days.

Autoimmune Disease Risks After Camp Lejeune Toxic Water Consumption

Autoimmune disease confuses your own immune system and causes it to attack the healthy cells in your organs and tissues. Anyone of any age can develop an autoimmune disease. Cases are more prevalent in women. Cases in children are rarer, but they can occur while babies are in the womb or after birth.

The National Library of Medicine reports there are more than 80 types of autoimmune diseases. They can affect almost any part of the body. These diseases may take the form of autoimmune hepatitis that attacks liver tissue. Type 1 diabetes instructs the immune system to attack the pancreas. Rheumatoid arthritis is a painful example of an autoimmune disease that attacks joints and in extreme cases, internal organs.

It’s believed that autoimmune disease can be genetic. Viruses may cause autoimmune diseases. Exposure to certain chemicals, like the toxic substances detected in Camp Lejeune water wells, could also trigger autoimmune disease.

Camp Lejeune Contaminants Linked to Autoimmune Diseases

The Agency for Toxic Substances and Disease Registry (ATSDR) reports that a least a couple of medical studies have linked the chemical known as trichloroethylene (TCE) and Tetrachloroethylene (PCE) to the development of autoimmune diseases.

Both TCE and PCE were detected in Camp Lejeune water supplies over a 35-year span. Additional research could show that those who consumed or came in contact with Camp Lejeune water faced an elevated risk of impaired immune system function and severe hypersensitivity skin disorder.

These devastating conditions and others can force patients to seek lifelong medical care and even be fatal. Victims and their families have likely suffered physical, emotional, and extreme financial hardships over their lives as they’ve coped with debilitating autoimmune disease side effects. A Camp Lejeune Toxic Water Lawyer can help victims who now reside in California earn support for their past damages and those healthcare costs expected in the future.

Securing Compensation for Autoimmune Disease in a Camp Lejeune Contaminated Water Claim

Military veterans and their families exposed to Camp Lejeune’s tainted water supplies during the eligible time period are able to file a claim. Civilians who worked on the base over this span may also be in line for compensation if they suffered harm to their health. Family members of disabled victims can file on their behalf.

Families of those autoimmune disease victims who have passed on, perhaps decades ago, are able to file a claim on a loved one’s behalf. Families would seek reimbursement for all past medical bills. They could also receive support for the care and income a deceased loved one can no longer provide the family.

First, patients and family members will need to prove their eligibility for benefits provided by the U.S. Government through the Camp Lejeune Justice Act. They’ll need to secure as many helpful documents as possible to turn over in their injury claims:

  • Medical documentation of a diagnosis, invoices for medical care, and birth records. Estimates on the costs of their care that might be needed in the years ahead or over a lifetime would also help determine the size of a Camp Lejeune toxic water autoimmune disease settlement.
  • Veterans of the Marine Corps and other branches of the U.S. Military would also need to provide service records showing they were at Camp Lejeune over the qualifying years. Children who were exposed to harmful chemicals must show that their mothers were serving or living on base before they were born.
  • Paystubs that show a loss of wages and benefits while victims could not go to work during treatment for autoimmune disease would also be vital.

The families of autoimmune victims young or old who have tragically died from the effects of their time at Camp Lejeune will also need to locate evidence. A skilled Maison Law attorney representing the family in a Camp Lejeune autoimmune disease wrongful death claim would track down documents from decades back if necessary to prove the government’s liability.
