Modesto, CA — On the morning of Thursday, October 8, 2026, 67-year-old Kathleen Erickson lost her life after a car crashed into her home, according to ABC10.
Emergency responders reportedly arrived at Erickson’s home near Encina Avenue and Fortuna Avenue in a residential area of central Modesto including Moran Estates Park around 9 AM. There, they found Erickson underneath the debris of her damaged home.
Inside the vehicle that struck Erickon’s home, authorities found two women and a child aged 12-years-old. All three received transportation to nearby medical facilities for treatment of their injuries.
According to initial investigations, which included statements from witnesses to the fatal accident, the driver of the vehicle that struck Erickson’s home appeared to have experienced a medical emergency that seemed as though it may have contributed toward her losing control of the vehicle, leading to the collision.
Driver intoxication is not believed to have played a role in the crash. This is an ongoing investigation.
Modesto Car Accidents and Wrongful Death and Personal Injury Claims
When the negligent actions of one or more parties results in someone’s accidental injury or death, a wrongful death or personal injury claim can provide a way to hold the responsible parties accountable, even if no criminal charges follow. A wrongful death claim can help compensate the family of the deceased for damages such as funeral expenses and the loss of companionship and support, while a personal injury claim can recover medical expenses, lost wages, and other related damages.
California law operates on the principle of comparative negligence, which recognizes that multiple parties may share liability in an accident. Fault is not considered all-or-nothing. Even if a party is only partially responsible, that can allow victims to receive some amount of compensation.
For instance, in the accident resulting in Erickson’s death, as well as the injury of those in the vehicle that crashed, while the driver may not be considered to be responsible for the medical event itself, investigations may determine that some of her actions — such as if she chose to drive knowing there might be a risk of a medical event — contributed to the crash, Erickson’s family and each of the driver’s passengers may have grounds for a wrongful death claim and personal injury claim, respectively.
Even if the passengers may have been related to the driver, families sometimes find it necessary to pursue legal action in order for their insurance to offer a proper settlement.
