Andrew Magana, 37, of Fresno, Killed in Pedestrian Crash on Hwy 99; DUI Suspected

Fresno, CA – Early Tuesday morning, January 27, 2026, a pedestrian was killed on southbound Highway 99 near Fresno Street, according to The Fresno Bee, with additional reporting from CHP Fatal.

The California Highway Patrol reports that multiple 911 calls came in around 12:45 AM regarding a man running in and out of traffic. Minutes later, calls indicated he had been struck by a vehicle.

Emergency personnel responded and pronounced the 37-year-old man, later identified by the Fresno County Coroner’s Office as Andrew Magana of Fresno, dead at the scene.

Investigators determined the driver who struck Magana was under the influence and arrested on suspicion of DUI, though the driver was taken to a hospital for treatment of injuries sustained in the crash. CHP stated it is unknown whether Magana was under the influence of drugs or alcohol, and toxicology results are pending.

Earlier reports indicate that CHP had responded to an abandoned Toyota Prius in the area around 12:10 AM. The vehicle was found with the door open and the engine running, and the driver had fled the scene. CHP later confirmed that Magana had been driving the Prius and left the vehicle prior to being struck.

CHP officers closed lanes on Highway 99 for the investigation and to clear the scene. The collision remains under investigation.

California DUI Law

Section 23153(a) of the California Vehicle Code (CVC) states that it is illegal for any driver to “Operate a vehicle under the influence of alcohol or drugs and, as a result, cause bodily injury to someone else.”

Pedestrian Fatalities and Wrongful Death Claims

Drivers have a Duty of Care towards pedestrians, which includes being vigilant for those travelling by foot and, if a collision occurs, staying with the victim, alerting emergency responders, and cooperating with authorities investigating the crash.

For those who lose a loved one in a pedestrian accident, filing a Wrongful Death claim with the assistance of an experienced attorney can provide compensation for medical bills, funeral costs, and other related damages.

Should the at-fault driver evade authorities, compensation might still be available through a family member’s uninsured driver coverage. Consulting with a personal injury attorney can help determine the best options in such cases.
