Fresno, CA – On the evening of Sunday, November 23, 2025, a pedestrian collision caused 48-year-old James Harvey to lose his life, according to KFSN.
The Fresno Police Department reports that the accident took place around 6:00 PM near Bullard Avenue and First Street.
Authorities said Harvey, who investigators believe may have been experiencing homelessness at the time, was walking in the area when a vehicle struck him just west of the intersection. Officers provided aid at the scene before transporting him to a local hospital, where his injuries proved fatal, despite medical efforts.
Police said the driver remained on scene and cooperated with the investigation. According to officials, drugs or alcohol do not appear to have contributed to the crash, and early findings suggest Harvey may have entered the roadway in a manner that placed him at risk.
Investigators continue to review evidence and have encouraged anyone with additional information to contact the department.
Partial Liability in Pedestrian Accidents
California Law does not consider pedestrians to have the right-of-way under all circumstances, such as if they attempt to cross outside of a crosswalk. However, motorists are never relieved of the expectation to provide pedestrians with a Duty of Care toward their safety.
It may therefore be determined that a motorist is subject to only partial liability in a pedestrian accident. Should that be the case, they would be financially responsible for the victim’s recovery costs in proportion to their degree of liability.
