Visalia Bicycle Collisions and Wrongful Death Claims
California law requires drivers to exercise an extra duty of care toward bicyclists they share the road with, due to their greater vulnerability to injury in a collision. When a bicycle accident takes place, motorists are required by law to stop and stay at the crash site, assist the bicyclist in acquiring medical aid, and cooperate with authorities when they arrive.
Failing to stay with an injured bicyclist after a crash is considered felony hit-and-run. By violating a traffic safety law, the driver involved may be determined to have committed “negligence per se,” increasing their share of liability for the victim’s injuries.
If the at-fault driver is apprehended, the victim’s family may have grounds to pursue a wrongful death claim with that driver’s insurance provider, separate from any criminal proceedings. If the driver escapes justice, the victim’s family may still be able to file a claim through their own uninsured motorist coverage.
A wrongful death claim can provide compensation for damages related to this fatal accident, such as funeral expenses and the loss of support and companionship provided by the deceased.
