Wrongful Death and Personal Injury Claims
California law requires drivers to maintain a safe following distance and remain attentive at all times to avoid rear-ending the vehicle ahead of them. When a rear-end collision results in the death of a driver, investigators with California law enforcement examine speed, following distance, and driver attentiveness to determine liability.
The family of the deceased driver may have the right to pursue a wrongful death claim, while the injured truck driver may have the right to pursue a personal injury claim. These claims can provide compensation for funeral expenses, loss of financial support, medical expenses, lost wages, pain and suffering, and other damages related to the accident.
