San Jose, CA – On the evening of Saturday, April 12, 2026, a suspected DUI collision resulted in a pedestrian losing his life in South San Jose, according to KRON.
The San Jose Police Department reports that the accident took place around 9:45 PM on Almaden Expressway south of San Jose Avenue.
Authorities said the driver of a 2008 Toyota sedan was traveling southbound on Almaden Expressway when he struck a man who was crossing the road outside of a marked crosswalk. The pedestrian was pronounced dead at the scene.
The driver remained at the scene and displayed “objective symptoms” of alcohol intoxication. Officers subsequently arrested the driver and booked him into the Santa Clara County Main Jail on suspicion of driving under the influence.

Pedestrian Fatalities and Wrongful Death Claims
Drivers have a duty of care towards pedestrians, which includes being vigilant for those travelling by foot and, if a collision occurs, staying with the victim, alerting emergency responders, and cooperating with authorities investigating the crash.
For those who lose a loved one in a pedestrian accident, filing a wrongful death claim with the assistance of an experienced attorney can provide compensation for medical bills, funeral costs, and other related damages.
