Fresno, CA – On the evening of Tuesday, December 9, 2025, a pedestrian collision left a man hospitalized after he suffered significant injuries when he was struck by a vehicle in heavy traffic, according to KSEE.
The Fresno Police Department reports that the accident took place just after 7:00 PM near Chestnut Avenue and Cesar Chavez Boulevard.
When officers arrived, they found the man down in the roadway with serious trauma and immediately began CPR to stabilize him while waiting for paramedics. Emergency crews then transported him to the hospital, where authorities later described his condition as stable, though his injuries required continued medical care.
Police said the man had been attempting to cross the roadway outside of a marked crosswalk and was moving through congested traffic when he was hit. The circumstances remain under review as investigators assess visibility, traffic flow, and the sequence of events leading to the collision.
Duty of Care Toward Pedestrians
Drivers have a Duty of Care towards pedestrians, who are particularly vulnerable in traffic accidents. This responsibility includes being vigilant for pedestrians near the roadway and, if a collision occurs, staying with the victim to ensure they get proper medical treatment and cooperating with authorities investigating the crash.
Partial Liability in Pedestrian Accidents
California Law does not consider pedestrians to have the right-of-way under all circumstances, such as if they attempt to cross outside of a crosswalk. However, motorists are never relieved of the expectation to provide pedestrians with a Duty of Care toward their safety.
It may therefore be determined that a motorist is subject to only partial liability in a pedestrian accident. Should that be the case, they would be financially responsible for the victim’s recovery costs in proportion to their degree of liability.
