Over the years, dangerous fatal accidents involving Amtrak have reportedly occurred in Montecito at Fernald Point Beach. Though many individuals have pushed for less hazardous access points to the beach that do not involve crossing dangerous train tracks, accidents still continue to occur and even take lives in these areas. If a loved one has lost their life in a train accident that you believe may not be their fault, there could be legal options available for you.
15-Year-Old Killed in Fatal Train Accident in Montecito
On Wednesday, June 19, 2024, a teen was tragically killed in a fatal Amtrak train accident in Montecito. According to information provided by KEYT, the accident occurred around 1:40 p.m. at Posilipo Lane at Fernald Point Beach.
A 15-year-old Santa Barbara teen was walking in the area during a birthday celebration and accessing an area that leads to the beach when he was struck by an Amtrak train. It is not yet known what direction the Amtrak train was traveling but traffic was delayed for several areas following the accident. The teen was tragically pronounced dead on scene.
The area of the accident is known for other fatal accidents, including one that took the life of an 18-year-old high school senior in 2017. Individuals living in the area have commented that there is no appropriate signage warning of train tracks in that particular area.
No further information has been provided but the investigation into the accident continues.
Support for Families Following Fatal California Train Accidents
When a pedestrian is struck by a train in a dangerous area, another party could sometimes be found at fault. Families could find themselves in the midst of a claim with a city municipality, the State of California, or the U.S. Federal Government depending on the circumstances of the accident. If there were known hazards in the area and a life was lost, families may be able to recover damages under California law.
Families may be eligible to recover some of the following damages in a fatal train accident claim:
- Medical bills their loved one incurred before passing
- Funeral and burial-related expenses
- Loss of companionship or consortium
- Pain and suffering damages
- Punitive damages in certain cases
Because it is not always easy to file a claim against the government and insurance companies sometimes try to pin the blame on victims in these cases, it is important that you consider your legal options. Turning to a legal advocate during these devastating times can ensure that your rights are being protected.
