Dangerous Pedestrian Accidents on Jackson Avenue in San Jose CA

All drivers in San Jose owe pedestrians a special “duty of care” as they travel. This means that drivers pay extra attention to spot anyone on foot who may be nearby. Motorists are then legally responsible for slowing down to show all due caution to a defenseless pedestrian. They must slow to whatever speed necessary to avoid a collision.

This duty means that drivers can be held liable for the harm that they cause no matter where they meet a pedestrian. Pedestrians and their families should expect financial support after a devastating accident.

Pedestrian Tragically Killed in Hit-And-Run San Jose Crash

An accident in eastern San Jose claimed the life of a pedestrian Saturday morning. KTVU-TV reports the collision took place around 7:41 a.m. near the intersection of North Jackson Avenue and Mather Drive near Regional Medical Center on January 22, 2022.

San Jose Police say a man driving a Toyota SUV struck the pedestrian and then left the scene. The driver in question reportedly stopped a short distance away, called 911, and returned to the scene.

Officers found the victim with serious injuries and he was rushed to the hospital. He was later pronounced dead.

The driver involved was cooperating with investigators as they worked to determine the circumstances surrounding the accident.

Finding Help for Families After a San Jose Pedestrian Accident

Getting the terrible news that a loved one has been lost will be something a family can never fully recover from. The emotional pain will last a lifetime.

A tragic pedestrian death can also saddle a family with ambulance fees and funeral expenses as well as the costs of settling someone’s estate. This doesn’t even take into account the loss of emotional support family members won’t ever be able to draw from again.

Close relatives are allowed under California law to file a wrongful death claim to ask an at-fault driver’s insurance provider for help with these costs. A wrongful death civil lawsuit also tries to protect family members’ financial futures when the income the deceased may have provided each week will no longer be available.
