Important Laws Every Motorist Must Follow

Every motorist must know the written and unwritten rules of the road. We all have a duty to drive with reasonable care and this includes a duty to obey California’s traffic laws. The following is a list of some of the most important laws or rules of the road that California motorists must follow:

*Speed Limits – California requires motorists to drive at a speed that would be considered safe under current conditions. Road and weather conditions, the amount of traffic, including the presence of bicyclist or pedestrian traffic, are real-time variables that determine the actual speed limit for a location.

*Following other vehicles – A driver must follow another driver at an assured clear distance. This means that you must maintain a clear distance between your vehicle and all vehicles in front of you. You must follow at a distance that “assures” that you can stop if the vehicle in front of you stops suddenly.

*Passing other vehicles – Drivers must pass to the left at a safe distance. You must stay in the passing lane until it is safe to re-merge with traffic into the right lane. If another car is in the process of passing you, do not increase your speed.

*Right of way – Never assume that other motorists will grant you the right of way. If you arrive at an intersection at the same time as another vehicle, the vehicle on the right has the right of way.

*Left turns – Drivers making a left turn must always activate a turning signal and should only turn when it is reasonably safe.

*School buses – When a school bus flashes its red lights, you must remain stopped from either direction until the children exiting the bus are out of the street and the lights stop flashing.

*Phones & electronic devices – In California, it is illegal to use a cell phone or similar electronic communication device while holding it in your hand. You may use a hands-free device. Any driver under the age of 18 is prohibited from using a cell phone for any reason.
