Liability In Pedestrian Accidents Involving DUI Drivers in Bakersfield CA

Bakersfield drivers are required to exercise caution around anyone on foot in the city, no matter where they encounter them. It’s a “duty of care” that every driver must observe because of the defenseless nature of any pedestrian when they must travel alongside the rush of traffic.

When a motorist chooses to drive while impaired by drugs or alcohol that care becomes nearly impossible. It becomes that much easier to miss seeing someone traveling by foot. A loss of focus and clear thought can lead to a devastating accident for someone simply trying to cross a road.

Pedestrian Hit by Suspected DUI Driver in Bakersfield

A pedestrian was badly hurt after being struck by a car Wednesday night in southern Bakersfield. KGET-TV reported the accident happened just past 8 p.m. on White Lane near Highway 99 on March 17, 2021.

Bakersfield Police say a man was crossing the street at the 2600 block of White Lane when he was hit by a vehicle. Tragically, officers found the man with major injuries when they arrived. The victim was taken to the hospital with injuries that were described as life-threatening. At last word, he was in critical condition.

Investigators say the driver involved was intoxicated. The DUI suspect was arrested and booked at the Kern County Jail.

Finding Help for Victims After a Pedestrian Accident in Bakersfield

Pedestrians should be given safe passage no matter where or when they travel, and when reckless drivers cause them to suffer injury their recovery costs should be covered. This may sound only fair for such a devastating incident, but it can be necessary for a victim or family members representing the victim to fight for that support during the healing process.

Victims can quickly face an enormous pile of hospital bills, including the cost of emergency response to the scene of an accident and ambulance fees. These costs can arise just as the victim begins to lose paychecks at work from having to miss shifts while they heal. This extreme financial burden is the reason victims are allowed to file a claim for damages against an at-fault driver and his or her insurance provider.

Drivers are legally bound to show care when around pedestrians even when they aren’t in crosswalks. Drivers and DUI suspects can still be held accountable for their mistakes that can cost victims and their families so much.
