Fatal Pedestrian Accident in Modesto

Pedestrians are always at risk when walking along busy streets and highways, but statistically they are in more danger in California than anywhere else in the United States.

It’s no secret how traffic in our state never seems to take a break and that can prove deadly to anyone near a road. California’s Office of Traffic Safety reported that the state’s pedestrian fatality rate is almost 25% higher than the national average.  More than 14,000 pedestrians were injured in accidents in California in 2018 and 893 pedestrians lost their lives.

These tragic numbers just underline how much damage a distracted driver can do when not paying attention to others who share the road with them.  The results can be a severe injury to the pedestrian or even the loss of life.

Modesto Fatal Pedestrian Accident on Highway 99

A 41-yr-old man was killed after being hit by two cars early Monday morning in Modesto.  CBS-13 TV reported the accident happened along Highway 99 just north of the Sierra Drive downtown overcrossing on August 10, 2020.

California Highway Patrol said the man was walking on the freeway around 3 am when he was struck by the first vehicle. That collision sent the pedestrian into the middle lane where he was struck by a second car.  This also sent the second car crashing into the guardrail.

The pedestrian was pronounced dead on the scene.  The second vehicle remained on the scene for the investigation.  The highway patrol is still seeking the driver of the first car.

Compensation after a Hit and Run Accident

The tragedy in a case of a fatal hit and run accident is overwhelming for the family left behind. A loved one is no longer around due to the negligence of a driver and that driver also took off to avoid the consequences.

What’s more, if the driver goes unidentified, the family may be stuck with bills that arrive in the wake of an accident. At the same time, the victim is no longer providing financial support for the family through his or her job.  If the victim had uninsured/underinsured insurance coverage, some of the costs may be covered through the policy.

If the driver responsible is located then the family is allowed to bring a wrongful death claim against the person and their insurance company.  A spouse or child or even a parent of the deceased may be able to file the claim on behalf of the close family that depended on the victim for financial and emotional support.

Any compensation awarded can help pay for any medical bills before the victim passed away and funeral costs.  It can also cover the future wages the deceased would have provided their family had they lived and been able to continue working.
