There are times when things happen that are unexpected and completely out of our control. For example, large rocks falling from a mountainside onto a highway. If those rocks strike and injure or kill a motorist or passenger in a vehicle, the event would be an accident. Then, there’s the human factor of being careless and negligent by failing to use reasonable care and caution while operating a motor vehicle that causes injuries or death. That would probably be classified as negligence.
California’s Negligence Statute
California has even codified the meaning of negligence. California Civil Code section 1714 states in pertinent part as follows: “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person . . . .” Maybe the most common scenario involving a want of ordinary care or skill is a simple rear-end collision when one car fails to stop at a red light, but the driver of the car behind it was distracted and crashed into the rear of the stopped car ahead of it. Some other examples of negligence might involve the following:
- Crashes caused by speeding or driving too fast for traffic or weather conditions.
- Collisions caused by following a vehicle ahead too closely.
- Slip-and-falls from a wet spot in a grocery store or a trip-and-fall from an uneven walking surface.
- A big box store stacking merchandise so high that it isn’t stable and falls on customers.
- Medical negligence when a surgeon performs the wrong procedure on a patient.
