Should I Sign a Release of All Claims Form?

By the time you reach the point of seeing a “release of all claims” form from an insurance company, you’ve already gone through a long, difficult process. That doesn’t even take the actual accident and your injuries into account. But one way or the other, it’s one of the last forms an insurance company is going to ask you to sign.

But whether you should sign it or not depends heavily on the circumstances. In short, it’s not something you want to rush into. So you should only think about signing when:

  • You have a reasonably clear idea of your injuries and treatment, including anything that might come up later
  • You’ve gotten all the medical care you need for your injuries from the accident
  • The settlement offer you’ve gotten from the insurance company covers everything you’ve lost so far, as well as anything you can reasonably expect in the future
  • You understand exactly what the form is saying—and there’s nothing vague or open-ended that could surprise you later

If any of that isn’t in place yet, it’s usually best to hold off in signing this form. The last thing you want is to sign and realize later that there’s more you need that you can no longer claim.

What Happens After I Sign a Release of All Claims Form?

Once you sign a release of all claims form, the claim is effectively closed. That means:

  • The insurance company has no further responsibility for your injuries or damages

With that closed off, you usually can’t get any more financial support from the insurance company in any way, including a lawsuit. Basically, once you sign, your claim is finished.   • Pictures/videos of the accident scene. Make sure to include any damage to vehicles, unsafe conditions, a lack of warning or safety signs, and any visible injuries.
  • Statements from witnesses about what they saw or also went through, as well as testimony from your doctors and other experts.
  • Emails, letters, and other correspondence from the insurance company that shows the back-and-forth.
