California Labor Code Section 1179: Wage Board Expenses

This Labor Board section should probably be repealed. Section 1179 of the California Labor Code authorizes compensation of $50 per day to wage board members for when they attend conferences. The complete statute follows: “The members of the wage board shall be allowed fifty dollars ($50) per diem and necessary traveling expenses while engaged in such conferences. The commission shall make rules governing the number and selection of the members and the mode and procedure of the wage board, and shall exercise exclusive jurisdiction over all questions regarding the validity of the procedure.”

Wage boards were established for purposes of investigating if the wages and working conditions of certain trades and industries are sufficient Before an investigation is concluded, they hold at least one public meeting on any issues its has investigated. The Labor Board then makes recommendations to the Industrial Welfare Commission. The Industrial Welfare Commission is then required to implement any regulations that are proposed, so long as they’re supported by a 2/3 majority of the wage board, unless it is found that that there is no substantial evidence on the record as a whole that would support the recommendation.

California’s Industrial Welfare Commission doesn’t even operate anymore. Its duties and function have been merged into the Division of Fair Labor Standards.
