Kings County, CA — On the morning of Thursday, November 5, 2026, a collision resulted in one person losing their life and another being hospitalized, according to ABC30.
The California Highway Patrol stated that the accident took place shortly after 6:30 AM near Highway 43 and Cairo Avenue, near Farmer’s Mini Mart in a rural area of Kings County.
According to investigators, a pickup truck traveling southbound on Highway 43 struck the left side of a sedan that pulled out into the intersection in front of it from Cairo Avenue.
The driver of the sedan, described as an elderly man, sustained fatal injuries in the crash, while his passenger received transportation to a nearby medical facility for treatment of major injuries.
The truck driver involved in the collision remained at the scene and cooperated with investigators, who believe that the early morning fog may have been a factor. However, the truck was not determined to have exceeded the posted speed limit.
The identities of those involved in this accident have not yet been released. This is an ongoing investigation.
Car Crashes in California: Wrongful Death and Personal Injury Claims
California law operates under the principle of comparative negligence, which holds that responsibility for an accident may be shared among multiple parties. Liability is therefore not an all-or-nothing proposition.
If it is determined that the truck driver was traveling at a speed too fast for the limited visibility caused by the morning fog, they may be found liable for the death of the sedan driver and injury of his passenger.
Even if the sedan driver is also found to have been partially negligent in the crash, it may still be possible for his family to pursue a wrongful death claim for at least partial compensation.
The compensation from a wrongful death claim can help recover damages such as funeral expenses and the loss of support and companionship the deceased provided.
Meanwhile, the sedan passenger could have grounds to pursue claims with either the truck driver, the sedan driver, or both. A personal injury claim can provide compensation for medical expenses, pain and suffering, and other damages related to the accident.
