Pedestrian Crashes in California and Personal Injury Claims
California law requires drivers to exercise a greater duty of care toward pedestrians due to their increased vulnerability to serious injury in a collision. Even if no criminal charges are filed against the driver involved in this pedestrian accident, they may still be found to have breached this duty of care and to be liable for his injuries.
The pedestrian may have grounds to pursue a personal injury claim. A personal injury claim can provide compensation for economic damages, like medical expenses and lost wages, as well as non-economic damages like pain and suffering. However, if the pedestrian is also found to have acted negligently in the collision, any settlement may be reduced.
