Fatal Car Accidents in Kern County and Wrongful Death Claims

California law operates on the principle of comparative negligence, which allows responsibility for an accident to be shared among multiple parties. Fault is therefore not an all-or-nothing proposition.

If negligence from the other driver involved in the crash — or outside parties like vehicle manufacturers or government agencies responsible for roadway maintenance — also contributed to the accident, Barraza’s family may have grounds for a wrongful death claim.

A wrongful death claim can provide compensation for funeral expenses and the loss of support and companionship the deceased provided. Should Barraza be found to share in the negligence that caused the crash as well, any settlement may be reduced, but that would not keep his family from receiving partial compensation.
