Fatal Scooter Crashes in California: Personal Injury and Wrongful Death Claims
If the pickup truck driver is found to have been negligent, the family of the scooter driver may have grounds for a wrongful death claim, while his passenger may have grounds for a personal injury claim, which their parents or a guardian will have to pursue on their behalf if they are a minor.
A wrongful death claim can provide compensation for damages such as funeral costs and the loss of any support and companionship the deceased provided. A personal injury claim can help to recover economic damages, such as medical expenses, with consideration for non-economic damages like pain and suffering as well.
