Sacramento, CA — According to KCRA, the infant who lost her life in a suspected DUI collision on Sunday, November 1, 2026, has been identified as 1-year-old Janessa Milagro Mazur Diaz.
The man with her who was hospitalized in the crash has been identified as her father, although his name has not yet been provided.
At approximately 4:45 PM, the Sacramento Police Department responded to reports of the fatal accident in the 6700 block of 21st Avenue at the Sacramento County Cemetery.
Emergency responders arriving at the scene provided Janessa and her father with transportation to a nearby hospital, where, despite the life-saving efforts of medical personnel, the infant girl lost her life.
SPD located the suspect, 50-year-old Miguel Guzman, of Sacramento, at the crash site and detained him.
Guzman was arrested and booked into the Sacramento County Main Jail on suspicion of gross vehicular manslaughter while intoxicated, driving under the influence and causing bodily injury, and willfully causing injury to a child.
California Pedestrian Accidents: Wrongful Death and Personal Injury Claims
If Guzman is confirmed as the driver involved in this fatal pedestrian accident, Janessa’s family may have grounds for a wrongful death claim, while her father may have grounds for a personal injury claim.
While no amount of money can replace a loved one, and the death of a child is especially painful, a wrongful death claim can provide compensation for damages such as funeral expenses and the pain of loss her family experiences.
If Guzman is convicted of driving while intoxicated, an attorney may also be able to help the victim’s family seek punitive damages as well, due to the flagrant disregard for the well-being of others.
As for Janessa’s father, a personal injury claim can recover economic damages, such as medical expenses and lost wages, as well as non-economic damages, like pain and suffering.
