San Jose, CA — In the early hours of Saturday, October 24, 2026, a pedestrian identified as Diego Armando Avila Tinoco, 29, of San Jose, lost his life in a collision with a motorcycle, according to KRON.
Around 1:26 AM, the San Jose Police Department responded to reports of an accident near the intersection of South Bascom Avenue and Fruitdale Avenue, a bustling area of shopping and dining in San Jose’s Fruitdale neighborhood.

This accident marks the 42nd fatal collision and the 20th pedestrian fatality of 2026.
SJPD asks that any member of the public with information regarding this accident come forward. This is an ongoing investigation.
Fatal Pedestrian Accidents in San Jose and Wrongful Death Claims
While no amount of money can bring back a loved one, the costs of losing them should be borne by those responsible. If the Kawasaki motorcyclist is proven to be at fault, Avila Tinoco’s family may have grounds for a wrongful death claim with his insurance provider. A wrongful death claim can provide compensation for damages such as funeral expenses and the loss of support and companionship provided by the deceased.
