Pedestrian Hit-and-Run Accidents in California and Wrongful Death Claims

California law requires drivers involved in an accident where a pedestrian is injured to remain at the site of the accident and cooperate with authorities. Failure to do so may be charged as a hit-and-run, which is a felony in cases of serious permanent injury or death.

If the driver involved in this fatal crash is located, the pedestrian’s family may have grounds to pursue a wrongful death claim with the driver’s insurance provider. A wrongful death claim can recover damages such as funeral expenses and the loss of support and companionship the deceased provided.

Should the driver escape justice, the pedestrian’s family may have other avenues available for compensation, which a wrongful death lawyer can help them explore.
