Pedestrian Accidents in California: Wrongful Death and Personal Injury Claims

California law requires drivers to exercise a greater duty of care toward pedestrians due to their vulnerability to serious injuries in a collision. They are expected to slow down and be ready to stop in areas where pedestrians may be present, like the residential neighborhood where this accident occurred.

The family of the woman who lost her life in this pedestrian crash may have grounds to pursue a wrongful death claim with the insurance provider of the driver involved. A wrongful death claim can provide compensation for damages such as funeral expenses and the loss of companionship and support from the deceased.

If negligence on the pedestrian’s part is found to have contributed to the fatal accident, any settlement may be reduced, but that would not bar her loved ones from seeking compensation.

However, a child under the age of five cannot share liability in an accident, and their family may have grounds for a personal injury claim. A personal injury claim can provide compensation for medical expenses, pain and suffering, and other damages stemming from the accident.
