San Jose Motorcycle Accidents and Wrongful Death Claims

California law operates under the legal principle of comparative negligence, which holds that multiple parties can share liability in an accident. If any actions on the part of the motorcyclist contributed to the collision, the value of any settlement received from a wrongful death claim may be reduced, in proportion to their share of liability.

However, this also means that the motorcyclist’s surviving family can still pursue a wrongful death claim even if the motorcyclist is found partially liable. A wrongful death claim can provide compensation for damages such as funeral expenses and the loss of emotional and financial support for any dependents of the deceased.
