Bakersfield Car Accidents and Wrongful Death Claims

California law follows the principle of comparative negligence. This means that even if a driver is found partially at fault for an accident, their surviving family members may still pursue compensation if the negligence of another party, such as a defect in the vehicle that contributed to the fire, played a role in the crash. Investigators with California law enforcement examine vehicle condition and the circumstances surrounding the collision to determine what caused the fire.

Because the crash occurred in a hotel parking lot, the property owner’s own security camera footage could offer investigators additional insight into Archie’s vehicle and driving pattern in the moments before the crash. His family may have the right to pursue a wrongful death claim, which can provide compensation for funeral expenses, loss of financial support, loss of consortium, and other damages related to the fatal accident.
