Fatal Crash into Canal near Overland Ave, H Street Kills 3 in Los Banos

Los Banos, CA – On the afternoon of Thursday, September 10, 2026, a single-vehicle collision resulted in the deaths of three people after their car overturned into a canal, according to ABC30.

The California Highway Patrol reports that the accident took place near Overland Avenue and H Street, west of Los Banos, in an agricultural area of Merced County where irrigation canals run alongside rural roadways.

Authorities said the vehicle was found upside down and fully submerged in the canal, with only its wheels visible above the roughly three to four feet of water. Approximately eight bystanders entered the water to attempt a rescue before emergency crews arrived, working together to flip the vehicle onto its side to access those trapped inside.

CHP described the effort as coordinated and determined, saying the number of people helping seemed to grow as the rescue continued. The bystanders were able to bring the occupants to the bank and begin CPR.

Despite those efforts, two of the three victims died at the scene, and the third later died at a hospital. Authorities said the victims, all from Los Banos, ranged in age from 59 to 69 and included a man and two women. Their identities had not been released at the time of reporting.

Overland Avenue and H Street were closed for several hours while CHP investigated. Stiers praised the bystanders’ actions, noting that most people would do the same for a family member in that situation.

The investigation remains ongoing.

Merced County Car Accidents and Wrongful Death Claims

California law follows the principle of comparative negligence. This means that even if a driver is found partially at fault for an accident, surviving family members may still pursue compensation if the negligence of another party, such as inadequate canal barriers or warning signage along the roadway, contributed to the crash. Investigators with California law enforcement examine roadway conditions and the circumstances surrounding the vehicle’s entry into the canal to determine what role such factors may have played.

Because rural canals like this one often lack the guardrails or barriers found along more heavily trafficked roads, the adequacy of the roadway’s safety infrastructure at this specific location could become a significant point of inquiry for the families pursuing a claim. The families of all three victims may have the right to pursue a wrongful death claim, which can provide compensation for funeral expenses, loss of financial support, loss of consortium, and other damages related to the fatal accident.

Passenger Liability and Wrongful Death Claims

A driver’s liability coverage extends to those inside their vehicle as well as outside. In many cases, those passengers are someone who knows the driver personally. So, when a passenger is injured and their driver is found liable, they may feel reluctant to file a claim against the driver’s insurance.

In many cases, however, a wrongful death claim may be required for an insurer to offer a fair settlement. A personal injury attorney can facilitate this process and, as a neutral third party, help navigate any emotional complexities that may arise.
