A 42-year-old man driving a white Mitsubishi Outlander southbound with his wife and son as passengers struck her. Vacaville Pedestrian Accidents and Wrongful Death Claims
California law follows the principle of comparative negligence. This means that even where a pedestrian’s own actions, such as standing or walking within a traffic lane, contributed to a crash, her surviving family members may still pursue compensation if the negligence of the driver, such as failing to keep a proper lookout in an unlit area, also contributed to her death. Investigators with California law enforcement examine visibility conditions, driver attentiveness, and the actions of both parties to determine what role each may have played.
Regardless of the findings, the woman’s family may have the right to pursue a wrongful death claim. A wrongful death claim can provide the family with compensation for funeral expenses, loss of financial support, loss of consortium, and other damages related to the fatal accident.
