Failure to Yield

In California, as in other states, “failure to yield” means that you didn’t give the right of way to the right person at the right time. As such, failure to yield or stop is closely related to the “right of way.” When a motorist fails to yield, stop, or otherwise avoid an accident and causes a crash, he or she can be held liable for injuries and damages suffered by a victim.

Fresno Car Accidents and Personal Injury Claims

California law requires all drivers, including those approaching intersections, to yield the right of way appropriately and remain alert to cross traffic. When a driver fails to yield and causes a collision with another vehicle, including a patrol vehicle, that driver may bear liability for the resulting injuries.

The officer injured in this collision may have the right to pursue a personal injury claim. A personal injury claim can provide compensation for medical expenses, lost wages, pain and suffering, and other damages related to the accident.
