California Hit-and-Run Laws

California law requires drivers involved in a collision to stop their vehicle, notify law enforcement, and exchange insurance information with others involved. Failure to do so, considered to be a “hit-and-run,” is a misdemeanor in cases of property damage and a felony when someone has been injured.

Gilroy Pedestrian Accidents and Wrongful Death Claims

California drivers are expected to exercise an additional duty of care toward pedestrians, remaining vigilant and prepared to stop when pedestrians are present in or near the roadway. When a collision occurs, a driver is expected to remain at the scene, render aid, alert emergency responders, and cooperate with investigators. A driver who flees the scene faces additional criminal exposure on top of any civil liability.

Regardless of whether criminal charges are ultimately filed against the driver, the family of the deceased may have the right to pursue a wrongful death claim. A wrongful death claim can provide the family with compensation for funeral expenses, loss of financial support, loss of consortium, and other damages related to the fatal accident. Should the at-fault driver evade justice, a personal injury attorney can help families explore what other options may be available.
