- Do you have enough evidence to show that someone else likely caused your injury?
So basically, prima facie negligence is the foundation of your injury claim. If you can show that you’ve been injured because somebody else was careless —and you can back it up with basic evidence—you’ve cleared the first hurdle of the claims process. But this flows naturally into the next question: how can I prove negligence?
How Can I Prove Prima Facie Negligence?
This is another thing that trips up a lot of injury victims. Proving prima facie negligence isn’t about having everything in order right now. It’s about showing that there was:
- A duty of care to act in a way that keeps you and others safe.

- There’s a causal link between the breach of duty and the accident itself.
