Modesto, CA – In the early hours of Monday, December 1, 2025, a pedestrian was struck and killed by a vehicle on Lake Road, according to FOX40.
The California Highway Patrol reports that the accident took place around 4:40 AM just east of Meier Road.
Authorities said the driver was traveling eastbound on Lake Road when a 39-year-old Modesto man walking within the eastbound traffic lane was struck. Evidence indicates that the driver may have attempted to swerve left to avoid the pedestrian, who also moved left, resulting in the collision.
Emergency personnel arrived to find the pedestrian with severe injuries. Despite life-saving measures, he was pronounced dead at the scene.
CHP confirmed that the driver was wearing a seat belt and was not under the influence of any mind-altering substances. It remains unknown whether the pedestrian had consumed any substances, and the incident continues under investigation.
Pedestrian Fatalities and Wrongful Death Claims
Drivers have a Duty of Care towards pedestrians, which includes being vigilant for those travelling by foot and, if a collision occurs, staying with the victim, alerting emergency responders, and cooperating with authorities investigating the crash.
For those who lose a loved one in a pedestrian accident, filing a Wrongful Death claim with the assistance of an experienced attorney can provide compensation for medical bills, funeral costs, and other related damages.
Should the at-fault driver evade authorities, compensation might still be available through a family member’s uninsured driver coverage. Consulting with a personal injury attorney can help determine the best options in such cases.
