San Jose, CA – On the early morning of Friday, July 18, 2025, a pedestrian was struck and killed in a collision near the Campbell area, according to Bay City News, with additional reporting from CHP Fatal.
The CHP reports that the incident occurred around 4:55 AM on northbound I-280, just south of Highway 17.
A man walking in the roadway entered traffic lanes and was hit by a northbound Toyota Corolla. The driver of the Toyota stopped at the scene and cooperated with authorities. Officers at the scene determined that drugs and alcohol were not contributing factors in the crash.
The pedestrian was found down in the high-occupancy vehicle lane, prompting an immediate response from emergency crews, including fire personnel and paramedics. The coroner was called to the scene shortly after.
Two of the four northbound lanes remained closed during the initial investigation, reopening just after 6:30 AM once the scene was cleared and the coroner completed on-site procedures.
The CHP is asking anyone with additional information about the incident to contact its San Jose area office. This is an ongoing investigation.
Partial Liability in Pedestrian Accidents
California Law does not consider pedestrians to have the right-of-way under all circumstances, such as if they attempt to cross outside of a crosswalk. However, motorists are never relieved of the expectation to provide pedestrians with a Duty of Care toward their safety.
It may therefore be determined that a motorist is subject to only partial liability in a pedestrian accident. Should that be the case, they would be financially responsible for the victim’s recovery costs in proportion to their degree of liability.
