Fatal Pedestrian Accidents in Stockton and Wrongful Death Claims

California law requires drivers to exercise a heightened duty of care toward pedestrians due to their greater vulnerability to injury in a collision. Drivers are expected to remain on alert and be prepared to stop when pedestrians are near the roadway, make every reasonable effort to avoid striking them, and remain at the scene to render aid and cooperate with authorities if a crash occurs.

The family of the deceased could have grounds for a wrongful death claim against the driver involved. A wrongful death claim can provide grieving families with compensation for damages such as funeral expenses and the loss of support and companionship the deceased provided.

If the driver is neither identified nor located, the victim’s family may yet have other avenues available to seek compensation, which a wrongful death lawyer could help them explore.
