Pedestrian Crashes in California and Personal Injury Claims
If found to have been driving under the influence, the driver involved in this accident may be considered to have committed negligence per se. This means that, by violating a traffic safety law, he may have met the legal criteria for negligence and may be found liable for the victim’s injuries.
Independent of any criminal proceedings against the driver, the pedestrian who was struck may have grounds to pursue a personal injury claim. A personal injury claim can provide compensation for economic damages, like medical expenses and lost wages, as well as non-economic damages like pain and suffering.
Because the pedestrian is a minor, a parent or guardian would be responsible for pursuing a claim on his behalf.
