Salinas Wrongful Death and Personal Injury Claims
California operates under the legal principle of comparative negligence, which allows for multiple parties to share liability for an accident. In a head-on collision, like this one, negligence on the part of both drivers may have contributed to the crash, in addition to vehicle manufacturers in the case of equipment failure, or local government responsible for road maintenance.
If a driver was found to be partially negligent in causing the crash that led to their injuries, fatal or not, any compensation from a wrongful death or personal injury claim could be reduced. However, pedestrians injured in the collision would have grounds to pursue civil suits whether their own or the other driver involved was found to be at fault.
A wrongful death claim allows the family of someone who lost their life due to the negligence of another to recover damages such as funeral costs and loss of companionship. As for personal injury claims, they can provide compensation for medical expenses, lost wages, pain and suffering, and other damages related to the crash.
