San Jose Pedestrian Accidents and Wrongful Death Claims

California law follows the principle of comparative negligence. This means that even where a pedestrian’s own actions, such as walking outside of a marked crosswalk, contributed to a crash, her surviving family members may still pursue compensation if the negligence of the driver, such as failing to keep a proper lookout, also contributed to her death. Investigators with California law enforcement examine visibility, speed, and the actions of both parties to determine what role each may have played.

Regardless of the findings, the woman’s family may have the right to pursue a wrongful death claim. A wrongful death claim can provide the family with compensation for funeral expenses, loss of financial support, loss of consortium, and other damages related to the fatal accident.
