Kern County Bicycle Accidents and Wrongful Death Claims

California law requires drivers to exercise a heightened duty of care around bicyclists, particularly minors, remaining alert and maintaining a safe following distance when riders are present on the roadway. When a driver strikes the rear of a bicycle and causes the death of a young rider, investigators with California law enforcement examine the driver’s conduct, visibility conditions, and other factors to determine liability.

Regardless of the findings, Vasquez’s family may have the right to pursue a wrongful death claim. A wrongful death claim can provide the family with compensation for funeral expenses, loss of financial support, loss of consortium, and other damages related to the fatal accident.
