Oakland Pedestrian Accidents and Wrongful Death Claims

California law requires drivers, including commercial truck operators, to exercise an extra duty of care toward pedestrians, particularly when making turns at intersections where crossing pedestrians may be difficult to see. When a truck driver turns into the path of a pedestrian and causes a fatal collision, investigators with California law enforcement examine visibility, mirror checks, and the driver’s conduct to determine whether negligence contributed to the crash.

Regardless of the findings, the victim’s family may have the right to pursue a wrongful death claim. A wrongful death claim can provide the family with compensation for funeral expenses, loss of financial support, loss of consortium, and other damages related to the fatal accident.
