Monterey County, CA – On the night of Tuesday, August 5, 2025, a pedestrian collision fatally injured Eudoro Moya Jr., 35, of Marina, according to KSBW.
The California Highway Patrol reports that the accident took place at approximately 9:57 PM on Reservation Road, just south of Blanco Road.
Authorities stated that a 16-year-old male from Seaside was driving southbound on Reservation Road when the vehicle struck Moya, who was also in the southbound lane. Moya sustained fatal injuries and was pronounced dead at the scene.
The teenage driver was not injured and remained at the location, cooperating with responding officers. CHP reported that the driver is not suspected of being under the influence, though it is unknown whether Moya was impaired at the time of the collision. Investigators have not yet confirmed whether the driver possessed a valid driver’s license.
The incident remains under investigation by the California Highway Patrol.
Duty of Care Toward Pedestrians
Drivers have a Duty of Care towards pedestrians, who are particularly vulnerable in traffic accidents. This responsibility includes being vigilant for pedestrians near the roadway and, if a collision occurs, staying with the victim to ensure they get proper medical treatment and cooperating with authorities investigating the crash.
Partial Liability in Pedestrian Accidents
California Law does not consider pedestrians to have the right-of-way under all circumstances, such as when they attempt to cross outside of a crosswalk. However, motorists are never relieved of the expectation to provide pedestrians with a Duty of Care toward their safety.
It may therefore be determined that a motorist is subject to only partial liability in a pedestrian accident. Should that be the case, they would be financially responsible for the victim’s recovery costs in proportion to their degree of liability.
