Pedestrian Accidents on Union Avenue in Bakersfield CA

Pedestrians who walk in Bakersfield are often put in high-risk situations simply to travel a half-mile or less. They can be expected to cross six and seven lanes of traffic in front of drivers who don’t bother to pay attention to what’s in front of them or even monitor traffic lights.

Drivers allow themselves to become distracted or to build excessive speed and end up with few options when they finally do spot someone on foot. Of course, a driver’s choice to abuse drugs or alcohol before getting behind the wheel puts pedestrians at even more risk of a dangerous accident.

California’s Transportation Injury Mapping System (TIMS) tracks Bakersfield accidents each year. Their data shows that drivers are a constant threat to pedestrians. In 2020, TIMS recorded 11 tragic pedestrian deaths and 100 pedestrian injuries in traffic collisions across the city.

Support for Victims After a Bakersfield Pedestrian Accident

Pedestrians travel with little protection and must risk terrible accidents when traveling near the rush of traffic. Injury victims and their families will be worried over the recovery that lies ahead. They may also wonder how much of their own recovery victims are expected to cover in an accident that occurred through no fault of their own.

The confusion over liability could be confused even more by the involvement of a suspected DUI driver. That driver will likely be facing criminal charges in court. Victims can take heart that they can still secure help with their hardships even if the suspect’s criminal case is ongoing.

Pedestrians and their families can file a civil claim for damages against the at-fault driver’s auto insurance provider. It will be resolved separately from the criminal proceedings. This claim would demand compensation from the insurance company for things like hospital and doctor bills and ambulance fees. The claim could also seek reimbursement for any missed time at work and lost paychecks. In this situation, the victim should be provided with anything he or she needs now and during any extended medical care needed in the future.
