Motorcycle Accidents Involving DUI Drivers in San Jose CA

Motorcyclists travel San Jose largely unprotected from the often devastating consequences of a traffic collision. It’s why drivers must always pay attention to the road in front of them and the lanes beside and behind their vehicles. One careless mistake by a driver can place a motorcycle rider at tremendous risk of a serious impact.

California’s Transportation Injury Mapping System (TIMS) tracks these accidents that those on motorcycles must endure far too frequently. In 2020, San Jose recorded a total of 89 motorcycle collisions. These incidents resulted in the tragic deaths of four people and left another 90 victims injured.

Drunk Driving Arrest After Deadly Motorcycle Accident in San Jose

A car struck a motorcycle in north San Jose Tuesday evening tragically taking the rider’s life. East Bay Times reports the accident happened around 7:45 p.m. at the intersection of Trimble and Zanker Roads on May 11, 2021.

San Jose Police say they arrested a man on suspicion of drunk driving after the Toyota Corolla he was driving ran a red light at the intersection and hit a motorcyclist. Investigators say the car was traveling south on Zanker road when it struck the motorcycle proceeding east on Trimble.  The rider passed away on the scene from his injuries.

The driver of the Corolla, a 21-year-old man from San Jose, stopped at the scene and was arrested on suspicion of vehicular manslaughter and felony DUI. The tragic accident marks the second fatal accident involving a motorcyclist this year in San Jose.

Assistance for Families After San Jose Motorcycle Accidents

The loss of a loved one will leave family members stunned and wondering how justice can be served. This desire for justice can become even more urgent after it’s learned that an at-fault driver chose to get behind the wheel while impaired by drugs or alcohol.

A DUI suspect will face criminal court proceedings, but the family of a victim doesn’t have to wait on the resolution of criminal charges to seek support for their hardships. A wrongful death civil claim can be filed against the driver’s car insurance provider to request help with the bills that result from a tragic accident.

Close relatives can ask for assistance with funeral and burial costs, ambulance and emergency response fees, and estate settlement expenses. The insurance company can also be asked to replace the financial support the deceased may have provided the family and would have continued to provide the family in the years to come. The emotional support and guidance the victim would have given the family in the future can also factor into a wrongful death claim.
