Camp Lejeune Justice Act Claim Deadline

Before a lawsuit can be filed under the Camp Lejeune Justice Act, notice of a tort claim must be filed with the federal government by the claimant or his or her representative. That claim must be filed within two years of the time that the cause of action arose. Causes of action under the Camp Lejeune Justice Act didn’t arise until August 10, 2022. That’s when President Joe Biden signed the legislation. As it became effective immediately, the deadline for filing federal tort claims under the act is August 10, 2024. Since filing such a claim is a prerequisite to filing a lawsuit under the Camp Lejeune Justice Act, the failure to file a claim by August 10, 2024, would operate to cause dismissal of any lawsuit based on contaminated Camp Lejeune water.

What if the Claim is Denied

If the government denies your claim, a special statute of limitations exists. Then, you only have 180 days from the date of denial to get your Camp Lejeune Justice Act lawsuit on file, even if your claim applies to a minor child. Failure to file within that 180-day period would also operate to dismiss a Camp Lejeune Justice Act lawsuit.
