Camp Lejeune Justice Act Passed for End-Stage Renal Disease Victims

Patients suffering harm after their exposure to polluted well water at Camp Lejeune received positive news when The Camp Lejeune Justice Act (CLJA) was passed in August of 2022.

The act removed legal obstacles for victims and their families hoping to seek compensation after suffering from major health issues. Victims who developed kidney conditions and end-stage renal disease after coming in contact with Camp Lejeune’s water can finally demand financial support from the U.S. Department of Defense.

To be eligible to file a claim, victims must show they served, lived, or worked at Camp Lejeune for at least 30 days at any point between August 1, 1953, and December 31, 1987. The 30 days of exposure do not have to have been on consecutive days.

Many kidney disease victims didn’t live long enough to seek justice for the harm they were subjected to, but their families can file claims on their behalf and secure settlement money.

End-Stage Renal Disease Caused by Chemical Exposure Through Camp Lejeune Water

Johns Hopkins Medicine states that end-stage renal failure is the final, permanent stage of chronic kidney disease. It means that kidney function has declined to the point that the kidneys can no longer function on their own.

Kidney failure leaves victims needing dialysis or a kidney transplant to stay alive. Patients will experience difficulty urinating or be unable to urinate. Patients will lose weight and suffer bone pain. Skin and nail changes, nausea, and headaches are also common.

It’s not surprising that ingesting harmful chemicals would do devastating damage to someone’s kidneys. The kidneys are supposed to filter out toxins from the body, but they aren’t equipped to handle the harmful substances found in Camp Lejeune water over more than three decades.

Trichloroethylene (TCE) and tetrachloroethylene (PCE) were found to be present in Camp Lejeune water wells over that span. CDC experts document that studies have linked TCE and PCE exposure to kidney cancers, renal toxicity, and end-stage renal failure.

Who Can File Camp Lejeune Justice Act Claims?

Somewhere around a million people may have been exposed to dangerous chemicals over a nearly 35-year span at Camp Lejeune Marine Corps Base. The potential victims who suffered kidney damage include more than just Marine veterans and their families.

This is a list of some of the potential end-stage renal disease victims allowed to seek Camp Lejeune toxic water settlement money from the U.S. government:

  • Military veterans who served at Camp Lejeune.
  • Service member families who lived on base.
  • Non-military workers employed on the base.
  • Individuals conceived and born after their mothers were exposed to these harmful chemicals.
  • Guardians for Camp Lejeune victims who are unable to file a claim for themselves. Guardians will usually be family members of the victim.
  • Family members of Camp Lejeune toxic water victims who have already passed on.

There are others living in California who may be eligible under the CLJA to receive benefits. It’s a good idea to schedule a free consultation with a skilled California Camp Lejeune Justice Act Lawyer to find out if you qualify and to get an idea of what your case may be worth.

How Long Do I Have to File a Camp Lejeune Toxic Water Claim Over End-Stage Renal Disease?

The Camp Lejeune Justice Act was passed on August 10, 2022. It set a two-year statute of limitations from the date of passage for victims with health issues stemming from contaminated water. Victims and their family members have until August 10, 2024, to file an injury claim with the federal government. Any claim filed after this time limit would most likely be rejected.

A Camp Lejeune End-Stage Renal Disease attorney will make sure your claim meets all deadlines and is filed as soon as all evidence is ready for submission. Your attorney will be collecting medical documents from as far back as necessary. A skilled attorney also works to get estimates on all medical care that may be necessary in the future for kidney patients.

Your lawyer secures military service records for you or loved ones to prove Camp Lejeune Justice Act eligibility. Income and benefits information and paystubs would be collected to show the wages you’ve had to forfeit while receiving treatment for kidney disease. The income lost to families in the future after a wage-earning loved one has passed on would also have to be calculated and requested in a Camp Lejeune Justice Act Settlement.

Your lawyer would seek additional compensation for the physical pain victims have endured and the emotional trauma they’ve experienced while suffering through end-stage renal disease.
