Esophageal Cancer From Camp Lejeune Contaminated Water

Maison Law is representing residents of California who experienced serious health issues such as esophageal cancer after exposure to contaminated water at Camp Lejeune in North Carolina.

Contact us today if you or a loved one developed cancer or any other health issue after exposure to Camp Lejeune’s toxic water between 1953 and 1987.

Camp Lejeune Dangerous Water Issues

It’s estimated that somewhere around a million people were exposed to hazardous chemicals in the water supply on Camp Lejeune Marine Corps Base. Harmful substances used at a nearby dry-cleaning facility and on base were detected in two water treatment systems serving Camp Lejeune.

The dangerous chemicals were present for almost 35 years and those who drank or came in contact with the water could have developed many health issues associated with the contaminants. Health hazards linked to these chemicals include many forms of cancer, including esophageal cancer.

Camp Lejeune Victims with Esophageal Cancer Eligible for Compensation

The Camp Lejeune Justice Act (CLJA) was signed into law on August 10, 2022. Its passage allows victims of Camp Lejeune water contamination to seek compensation from the U.S. Government for illnesses caused by their exposure. Victims and their families now have up to two years from the date of the signing to bring a claim against the U.S. Department of Defense.

In order to proceed with a CLJA lawsuit, victims must have been in contact with the water at Camp Lejeune for at least 30 days between August 1, 1953, and December 31, 1987. The 30 days of exposure do not have to have been continuous.

These and other parties are permitted to move forward with a Camp Lejeune toxic water esophageal cancer lawsuit:

  • Military veterans from all branches who served at Camp Lejeune and their families who lived on base.
  • Non-military employees and contractors who worked on the base.
  • Individuals conceived after their mothers were exposed to Camp Lejeune’s water supplies.
  • Caregivers/Guardians for Camp Lejeune victims who are incapacitated and can’t file a claim for themselves.
  • Family members who have lost loved ones to health issues caused by exposure to toxic water on the Marine Corps Base.

Esophageal Cancer After Camp Lejeune Toxic Water Exposure

The esophagus is the hollow, muscular tube that pushes food from the throat down to the stomach. The National Cancer Institute reports that when cancer cells develop in the esophagus, they start in the inside lining of the esophagus and then spread outward to other layers. Patients will have difficulty swallowing and may start to lose weight as it becomes harder and harder to eat.

Trichloroethylene (TCE) and tetrachloroethylene (PCE) were two of the most prevalent chemicals discovered in Camp Lejeune wells. The CDC details how at least three different studies have linked exposure to these chemicals to cases of esophageal cancer.

A California Camp Lejeune Water Contamination Lawyer would use this data and other studies to show the clear link between toxic water and a client’s development of esophageal cancer. By securing documents showing the hardships victims and their families have faced during cancer treatment, a skilled lawyer works to get the most out of a Camp Lejeune esophageal cancer injury claim.

Securing Camp Lejeune Esophageal Cancer Compensation for California Victims

To maximize the Camp Lejeune toxic water settlement you and your family receive, you’ll need to gather as many documents as you have possession of. Your esophageal cancer attorney will also be investigating your case and will retrieve records from as far back as necessary to build a strong case for you.

These are just a few of the documents that will serve as powerful evidence for your case against the U.S. Department of Defense:

  • Medical documents – Your lawyer would seek out medical records and hospital invoices going back decades if necessary. Doctor’s diagnoses and charts showing your recovery path from esophageal cancer will become vital to your case.
  • Military documents – If you are a service member or your parents were service members assigned to Camp Lejeune, you’ll need service records to demonstrate a minimum of 30 days of exposure to these toxic chemicals.
  • Work documents – If you were a civilian working on Camp Lejeune, your pay stubs will document your exposure to contaminated water for 30 days or more. Pay stubs will also be important for anyone who will be filing a toxic water claim. The paychecks will prove the income forfeited as esophageal cancer patients missed weeks of work or, perhaps, could never return to work to support their families again.

This evidence and other proof of hardships will be key to maximizing compensation for Camp Lejeune victims and their families.

The following factors and others will be key when the amount of a contaminated water settlement is decided:

  • Past, current, and future medical bills.
  • Support for the pain a victim endures during treatment for esophageal cancers, including during surgery recovery and chemotherapy.
  • Support for the emotional trauma cancer patients and their families endure. The anxiety and depression that can follow a difficult cancer treatment schedule.
  • Support for a loss of consortium (loss of intimacy with a partner).
  • Support for a loss of enjoyment of life.
  • Loss of earnings unable to work while in recovery from esophageal cancer. Lifetime support when cancer forces victims to give up their careers or military service.
  • Wrongful death benefits. Families of Camp Lejeune water victims should demand reimbursement for funeral costs and the enormous medical bills patients likely built up before they passed on. Close relatives would also count on a Camp Lejeune contaminated water wrongful death claim to secure additional assistance replacing the income the deceased could no longer provide the family.
